These terms of use (the “Terms”) govern access to and use of the website constructionprohabitat.com. By accessing the site or submitting a request, you acknowledge having read these Terms and agree to abide by them.

2. Nature of the site
The site presents our services and lets you contact us. No information shown constitutes a binding contractual offer. Any quote or estimate sent electronically is non-binding until a written contract is signed by both parties and the required deposit, if any, has been received.
3. Quotes
Every estimate is valid for a maximum of 30 days from its issue date, unless otherwise stated in writing. After that, prices may change based on material and labour costs, without notice. Quotes provided without an on-site visit remain approximate and may be revised after inspection.
4. Client responsibilities
The client agrees to:
- Provide accurate, complete and current information;
- Allow safe access to the premises;
- Obtain the required municipal permits, unless agreed otherwise in writing;
- Pay sums due according to the agreed terms;
- Promptly communicate any observation that may affect the work.
Any delay, additional cost or damage caused by a client breach of these obligations remains the client's sole responsibility.
5. Warranties
Eligible residential work is covered by the applicable warranty plan in accordance with Régie du bâtiment du Québec rules. For work not covered by a mandatory plan, a workmanship warranty of twelve (12) monthsfrom completion applies. Materials are covered by their manufacturers' respective warranties.
No warranty, express or implied, beyond those stated in the work contract may be relied upon. The following are excluded: normal wear and tear, damage from improper use, lack of maintenance, third-party modifications, construction defects predating our work, and events of force majeure.
6. Limitation of liability
To the fullest extent permitted by law, Pro-Habitat's liability to the client is limited to the amount actually paid for the work that is the subject of the claim. Pro-Habitat disclaims all liability for indirect, consequential, economic damages, lost profits, loss of use or loss of enjoyment, whether foreseeable or not.
Site content is provided “as is”, without warranty of accuracy or completeness. Pro-Habitat cannot be held liable for decisions made based on information shown without prior consultation.
7. Intellectual property
All site content (text, images, videos, logos, structure, graphics) is the exclusive property of Pro-Habitat or used under licence. Any reproduction, distribution or use without prior written authorization is strictly prohibited. Third-party brands shown (supplier partners) remain the property of their respective owners.
8. Acceptable conduct and use
Accessing the site implies a commitment not to:
- Submit false information in forms;
- Attempt to access sections not intended for the public;
- Automatically harvest site data (scraping, bots);
- Use the site for illegal, fraudulent or defamatory purposes;
- Distribute viruses or other malicious code.
Pro-Habitat reserves the right to block access and pursue any offending user.
9. External links
The site may link to third-party sites (e.g. financing partners). Pro-Habitat exercises no control over those sites and disclaims all liability for their content, privacy policies or practices.
10. Force majeure
Pro-Habitat cannot be held liable for any delay or non-performance resulting from an event beyond its reasonable control, including but not limited to: exceptional weather, labour disputes, material shortages, prolonged power outage, fire, flood, pandemic, government or regulatory act, and any case of force majeure under the Civil Code of Quebec.
11. Indemnification
The client agrees to indemnify and hold Pro-Habitat harmless from any claim, action, damage, cost or expense (including reasonable legal fees) arising from non-compliance with these Terms or improper use of the site or our services.
12. Dispute resolution
In case of dispute, the parties agree to favour amicable resolution. Otherwise, they will attempt mediation before any judicial proceedings. Any litigation will then fall within the exclusive jurisdiction of the courts of the judicial district of Trois-Rivières, under the laws of the province of Quebec.
13. Changes to the Terms
Pro-Habitat may modify the Terms at any time. Continued use of the site after modifications are published constitutes acceptance. It is the user's responsibility to consult the version in force periodically.
14. Severability
If a provision of the Terms is held invalid, illegal or unenforceable by a competent court, the remaining provisions remain fully in force.
